Judicialization is a phenomenon of contemporary democracies that consists in the intervention of judicial bodies in different social spheres, in the resolution of conflicts and in the protection of individual and collective rights. In the educational sphere, judicialization can be seen in the difficulty of schools in managing conflicts using discourses and practices based on the regulation of the law and punishment. In this article, we discuss the judicialization of conflicts involving religion and school in three parts: 1) we analyze the judicialization of life in contemporary democracies; 2) we explore the disputes around the discipline of religious education and the presence of religion in schools; and 3) we discuss a situation of religiously motivated school conflict that was judicialized. We conclude that judicialization is configured as an indication, consequence and instrument for managing conflicts involving religion in school contexts.
