In the modern State the historical origin of institucional and the politician of any institution or organization of the current society will be all. The existence decurrent human being and its necessities in society had preceded the historical production of the modern State and its institutions for the construction, regulation and consolidation of the social pact. Convém to detach here since soon that the public identifies itself with the society, of a side, giving origin to the power politician who will materialize itself in the State and, of another one, that the public becomes the antithetic polar region of the private one in the scope of the society and the State. Of this if it can conclude, with Locke, that the institucional nature of the modern State and the power politician for exerted it emerges of the society and it must submit itself. Therefore, since the creation of the State and particularly of the modern State, a contradiction between the public and private in the any sphere of activity human being exists, especially, in the interior of the proper State and of its institutions. Such historical contradiction drift, of a side, the grant of the activities to legislate, to judge and to execute, that they are individual in the natural state, for the normative sphere of the social pact, the State; of another one, of the same institution that supports the social pact by means of the power politician who is the State. Thus, he can yourself be pointed with respect to a double movement that would produce the indissociável public-private contradiction in the society and the modern State. This implies to affirm the predominance of a polar region da contradiction - the public - or do its antithetic one - the private one - in function of as if they organize the society, the State and the relations between them mediated pelo to be able politician with base na nature and na economy. However, as its place is the society, its ethos must be, according to classic liberal doctrine, predominantly public. In this picture one configures the social pact and its producer, the citizen, as well as the quality of being citizen: the citizenship.
