The fight against inequalities is indeed the main focus of all education systems. Despite this noble aim, the reality of the Portuguese system shows that the search for equity is far from being attained. The democratic regime has certainly improved the general conditions with regards to formal access to education. However, in practice, the segregation between classes, sexes and ethnies remains as a de facto inequality. This article discusses the reality of this situation, as an attempt to describe the most patent cases of inequality in education in Portugal. As such, gender and religious discrimination are of special relevance in the Portuguese context. The paper also emphasizes the limits of the legal concepts in order to tackle discrimination, and the need to re-think tools that as used in most legal system. This is the case of laws against discrimination, but also instruments such as positive action measures and mainstreaming process tools against discrimination in the education sector, as well as in other sectors essentials to the promotion of democratic rights.
