Abstract

RODRIGUES, Rayane Vieira; ROCHA, Janaína Ibiapina da; OLIVEIRA, Vanessa Elias de  and  XIMENES, Salomão Barros. THE EFFECTS OF JUDICIALIZATION IN EDUCATIONAL POLICIES OF FOUR MUNICIPALITIES IN SÃO PAULO. Educ. Teoria Prática [online]. 2021, vol.31, n.64, e44. ISSN 1981-8106.  https://doi.org/10.18675/1981-8106.v31.n.64.s14610.

This article aims to identify the effects of judicialization in childhood education policy cycle. To this end, it classified the direct and indirect effects of extrajudicial and collective judicial demands (terms of conduct adjustment and civil action, respectively) on child education policy in four municipalities in São Paulo: São Paulo, Mauá, Caieiras, and Paulínia. The results indicate that despite differing as to the local context, judicialization effects provide an analytical framework when analyzed in an integrated manner. Increased offer of vacancies in daycare centers, changes in government programs, and budget allocation for education were some of the direct effects identified. On the other hand, indirect effects included the change in service provision structure and reorganization of administrative structure; establishment of new accountability mechanisms and changes in interinstitutional relations; and the creation of new legislation and municipal programs.

Keywords : Judicialization of policy; Preschool education; Right to education; Judiciary.
