This article aims to systematize speculations on the perception of Researchers and Social Movements in relation to the Legal Opinion CNE/CP 05/2020 through the analysis of the contributions generated after its approval. The text is an exercise in thinking about the impacts generated, especially for the organization of the curriculum in Early Childhood Education. The guiding question was: What are the impacts of Legal Opinion 05/2020 on early childhood education in Brazil during the pandemic period? It is configured as a systematic database review, targeting peer-reviewed articles, published between June 2020 and June 2021. The result allowed to evidence the imminent risk of adopting textbooks and the possibility of homeschooling as background intentions of the Legal Opinion CNE/CP 05/2020. It is also noteworthy that the circumstance imposed by the Pandemic does not exclude the specificities of early childhood education and, it is imperative to exclaim about the imminence of loss of conquered rights and its consequences.
