In this article, the right to education of migrant and refugee children in Brazilian public schools is discussed. For this, qualitative research of a documentary nature is carried out, of Resolution nº 1 of November 13, 2020, issued by the Basic Education Chamber of the National Council of Education. It is the first federal document that specifically addresses basic education for the population coming from international migratory flows. The analysis of the document aims to understand how the resolution presents the right to education of migrant and refugee children, observing the context of public schools. The result of the analysis shows that the document deals with this right in two axes: enrollment and education, so that one is inseparable from the other. However, despite considering the right to education beyond enrollment, the resolution places responsibility on the local school, which often receives children without the institution's professionals having support and guidance. The document also does not include other actors necessary for the realization of this right, such as states and cities, in addition to universities, which work in teacher training.
