The aim of this paper is to study the legal itinerary of the Spanish educative system on behalf of students with mental and physical disabilities. Since the Moyano Law to the General Law on Education school segregation was a reality within the Spanish schools. Curricula have always gone hand in hand with the path of Special Education in Spain, segregating male and female students from the regular lessons. Education has reproduced and sanctioned inequalities within the legal framework that guaranteed equal opportunities. Nowadays, the LOGSE wants to establish a “school for everybody” policy that includes all its members no matter their personal peculiarities. The inclusive school must find a solution to students’ diversity.
