In this paper we analyze the different views on the right to education in the current situation in Latin America, from three dimensions. In the first place the historical formation of the rights associated with the ideas of citizenship and nation-states designed as "imagined communities" in formally homogeneous times. Secondly, the different conceptions in dispute over the right to education and the functions assigned to the state and other educational agents in each of these conceptions. Finally, the old and new policies aimed at realizing the right to education in a scenario tensioned between democratization and commodification of knowledge.
