The discussion about the quality of basic education that assists today reveals a fundamental paradox in the brazilian educational policies, because, to focus on the assessment, draws the center of the discussion about the right and directs their senses to the administrative rationality that pursues the efficiency at any price. Among the search of results, will be losing in the process the historical construction of education as a commonweal, a social right and that, as such, cannot be regulated as a merchandise. This happens in a context of detached legitimation of external evaluation, based on a merit system. The complexity of the discussion rests precisely on the fact that the education as public policy, from the last decades of the twentieth century, also gained as concern the inclusion of important social segments that were jettisoned of the enjoyment of the fundamental rights in the history of country, precisely for not responding to the prevailing meritocratic criterions in the Brazilian school system.
