Taking as reference the exploratory study carried out by Araújo (2015) about practices and strategies for providing full-time programs in early childhood education in twenty public institutions in the state of Espírito Santo, this paper investigates the condition of vulnerability and social risk of children and their families used as the predominant enrollment criterion, according to reports of 90% of the managers interviewed. It calls attention to the crucial discussion about the way that the demand for full-time vacancies has resulted in controversial forms of access by keeping children closer to the “merit of need” than to the prerogatives of law. It is concluded that when the “merit of need” is established as the predominant criterion of access to full-time programs in early childhood education, a reductionist view of law is incorporated, subverting it as an equalizing resource of opportunities and as an instance of societal mediation.
