Special education from the perspective of inclusive education hás guided the development of educational policies in Brazil since the first decade of the 2000s. In the State of Santa Catarina, the Base Curriculum of the Territory of Early Childhood Education and Elementary Education, published in 2019, reaffirms the inclusive character of Special Education and highlights curricular justice as one of its principles. This article aims to discuss the notion of curricular justice and its relationship with Special Education, within the scope of the Currículo Base do Território Catarinense (2019). The research, based on a qualitative approach, had bibliographical and documental research as data production instruments. The results show that there is a lack of educational research about curricular justice, especially in the area of Special Education. The analysis of the Currículo Base do Território Catarinense (2019) showed that curricular justice, mentioned only in the section dedicated to Special Education of the document, addresses, in addition to the Idea of curricular flexibility, a curriculum perspective that is based on assumptions of equity, democracy and justice that can contribute to new ways of thinking Special Education.
