The article aims to analyze the subjective dimension involved in the drafting, dissemination, suspension, revocation of Decree nº 10.502/2020, the new National Policy on Special Education: equitable, inclusive and lifelong learning. The analysis is based on the Theory of Subjectivity, with an emphasis on the category of social subjectivity, considering its heuristic value to understand social processes in their subjective dimension configured within the scope of the actions of individuals, groups and institutions. The study is guided by a constructive-interpretative process of information and documentary records identified in the process of preparing and disseminating the document, its suspension by the Federal Supreme Court, its revocation in 2023 and the current attempts to resume it in the National Congress. These are political, legal and socio-relational acts traversed by power relations, values, beliefs, interests that express the social subjectivity of groups and institutions participating in disputes regarding the inclusive perspective of Special Education, in the context of the regressive agenda underway in Brazil.
