The current article aims to study the supervision and the assessment procedures of higher education, foreseen in the Decree nº 5.773/06, under the prism of the 1988 Constitution of the Republic of Brazil (CR/88) and under the Law nº 10.861/04, which inaugurated the Higher Education National System of Assessment (Sinaes). In a dogmatic perspective, this article is mainly a theoretical-documentary work. Even if institutions of Higher Education (IES) ceases its activities, one has understood that the rights of the students enrolled in the courses to conclude the degree still deserve administrative regulation. In addition, the procedure to apply penalties to those institutions that have not reached the protocol commitment (previous periodic process of assessment of the Sinaes) is illegal because it violates the §§ 3º and 4º of article 10 of the Law nº 10.861/2004.
