The article aimed to sustain the need of overcoming the absence of complementary standardization to the constitutional imperative of cooperative action among the Federation Entities in order to guarantee the means of access to education. Considered in the 23rd article of the Brazilian Constitution, the complementary law has not taken shape yet, even after 25 years of the enactment of the constitution. Considering the changes brought by the 53 and 59 constitutional amendments and the improvement of institutional relations to deal with the extension of compulsory education and public subjective rights, particularly achieved in the last decade, it presents a regulation proposal which aims to contemplate the occurrence of tensions among the typical autonomies of Federation, the constitutional imperative of overcoming inequalities, the institution of a national education system and the necessity of creating institutional spaces of agreement, binding standards, democratic participation and social control.
