This study aims to analyze how the modality of special education is organized in the Brazilian federative system after the CF/1988 in articulation with the managing and political aspects of Apaes National Federation (Fenapaes). This is a documental study about the Brazilian legislation as well as about the Apaes Federation’s projects and programs. The results indicates that school municipalization in Brazil had different outcomes for Fenapaes with its expansion and financial resources for social services, among them, education. Apaes Federation and the reform of the state propelled the consolidation of a parallel branch of schools for special education by transferring resources to philanthropic institutions.
