After 15 years of Law enforcement 10639/2003 new focus of tensions arise for the education of ethic-racial relations having a background against the Brazilian political crisis. This situation raises the need to reflect on how to achieve its full effectiveness posed by the National Curricular Common Base. (NCCB). To achieve such objective a bibliographic research was conducted based on the analysis of academic articles, books, official documents and digital publications of entities representative of teachers and researchers of education. The results show that, despite the challenges, some normative instruments still guarantee the continuing of the work in favor of the implementation of said Law since the Law of Guidelines and Basic of Education. (GBE) n. 9394/93 and new National Curricular Guidelines for the initial training at the higher level and for the continuing education primary school teachers resolution n. 02/ 2015, among others, assert that the weaknesses can be softened.
