Abstract

The purpose of this paper is to discuss educational public policies, in particular Laws 10,639/03 and 11,645/08 which are the result of ancient struggles of social movements, especially the Black Movement. The socio-historical and political context about the emergence of these laws is presented and, in the opportunity, an overview of the treatment given by the public power to the racial issue. It undertakes a discussion about affirmative actions and educational policies, regarding the analysis of these two laws. It is considered that the implementation of these two laws meant establishing new guidelines and pedagogical practices, recognizing the importance and contribution of the black and indigenous populations in the process of formation of Brazilian society. In this sense, Laws No. 10,639 / 03 and No. 11,645 / 08 must be seen as a fundamental part of the set of policies aimed at quality and equal education. Although the debate on the object of this study has been shaped by the affirmative policies and most of those involved in the theme understands these laws as an affirmative action policy, given the treatment given to the issues of the Brazilian black and indigenous population, given From the definitions presented here, it is possible to consider that Laws 10.639 / 03 and 11.645 / 08 do not constitute in the field of affirmative actions, as they deal with policies of permanent and non-transitory character; directed not only to the black and indigenous population, but to Brazilian society.
