Abstract

This article aims to analyze the administration of justice in Portuguese America on seventeenth century, based in assumptions of Norbert Elias’s theory. The Philippine Ordinances, a legal code published in 1603, are analyzed in more detail. It is understood thatthe Ordinances express the effort of control of the State over individuals, possible thanks to the monopolization of physical violence. The analysis has contributions from Bourdieu that make it possible to discuss the place of law in the social configuration, especially in the aspect of “symbolic power” as an instrument of control. Therefore, the norm state the desire to control human actions, curbing unwanted behaviors and motivating what is considered ideal practices in this context. It expresses the need to regulate the activities of the State and, more specifically, the individual actions, expressing a constant correspondence between the social and individual structure. In addition to physical strength, devices capable of arousing feelings with conditions to act on the internalization of habits are identified.
