Abstract In the occasion of the enrollment for the 1997 and 1998 entrance test of the UFMT, the MPF sued the UFMT, stating that the collection of the enrollment fee for the entrance test was illegal and unconstitutional. In reply the Federal Justice gave preliminary order prohibiting the UFMT of charging it. This caused a great search of candidates for free enrollments. Later the UFMT appealed, cancelling the preliminary order. Methodologically, the research realized followed the qualitative perspective with a phenomenological guide and aimed to the historical rescue such events to reflect about the meaning of the gratuity of the enrollment for the IFES entrance tests, here considered as a beginning of social inclusion and acknowledgement of the right to higher education.
