This article proposes that the inequality and social justice are still pending issues for the higher education. It discusses the issue of the inequality in higher education from three axs: one internal to the institution linked to the specific characteristics of this educational device, one that challenges the social function of the institution, for what you need be read from the articulation between the university and society and a third rather external, related to the State and public policies that include educational, that the debate about the autonomy and public responsibility.
