Abstract

This article presents the results of an analysis of the National Policy on Special Education from the Perspective of Inclusive Education, of 2008, and of Decree No. 10.502/2020 (PNEE-2020), aiming to identify continuities and ruptures regarding to the educational locus of special education. It was found that the PNEE-2020 expressed an attempt to reinforce old paradigms of special education (integration, segregation, biomedical model of disability and the substitutive character), privileging educational assistance via private initiative, constituting an obstacle in the fight for rights of people with disabilities, especially regarding to public education.
