The affirmation that the Federal Constitution of 1988 assures the right and access of young children to early childhood education, through positive actions by the democratic Brazilian State, needs to be reaffirmed. Bringing up the compromises, through legal regulations, at such early age citizens is urgent, moreover, in times of frontal attack on the young Brazilian democracy, to build wholeness of legal words in their constitutional origin, and in the effectiveness of the right to access and offer. Thus, the objective of this article is to research and analyze the offer of public vacancies for early childhood education in the state of Tocantins, Brazil, between the years of 1990 and 2020, unveiling the evolution to the access and the subtraction of the benefit to many children from Tocantins state.
