The importance of evaluation to ensure quality in education is consensus in the educational sector, task required under the legislation to the right of operation of free initiative in higher education. In Brazil, a National Evaluation System of Higher Education (SINAES), established by Law 10.861/04, should conduct the evaluation. However, it is essential to monitor the implementation of this system, by observing the current processes for the regulation of higher education institutions and their courses, trying to discuss if the SINAES is an implanted system as its conception or if it was threatened by supervision and control operations by the regulatory state.
