Changes in the Brazilian political scenery have caused a context of counter-reforms which are result from the ultra-conservative neoliberal tendency that affect acquired social rights, generating important implications for educational policies under the influence of international organizations. The Decree 10.502/2020 established by the Ministry of Education threatens the 2008 Política Nacional de Educação Especial na Perspectiva da Educação Inclusiva (PNEEPEI) - Brazilian National Policy on Special-needs Education - with repeal. This paper aims to analyze the changes proposed in the revision of PNEEPEI by the mentioned Decree in correlation with international documents and ultra-conservative policies. The research is qualitative based on documents. Results point to the relevance of PNEEPEI in advancing inclusive education. The Decree, inspired by Inchoen Declaration, aims at modifying the organization of Special-Needs Education, representing risks to the maintenance of an inclusive perspective when defending, among other aspects, the de-characterization of Specialized Educational Assistance; encouraging enrollment in specialized centers; expansion of private sector participation; delegate to the families the decision on enrollment. It is concluded that inclusion is a complex and continuous construction and does not occur only by changing the organization of Special-Needs Education, but by changing the excluding structure of education as whole in order to guarantee access and learning.
