This study aims to highlight the importance of hospital and home educational care for students away from school activities who are prevented from attending regular school due to hospitalization for reasons of health treatment in Brazil from the perspective of human rights. Education is everyone's right, it is provided for in Article 6 of the Federal Constitution of 1988 as a fundamental right of a social nature, a duty of the State and the family, promoted and encouraged with the collaboration of society. The development of the research was carried out through a bibliographical research seeking in the literature subjects, concepts and definitions on the theme that deal with the subject. Hospital and home educational care is a teaching modality that supports access to education, which is an inalienable right of every citizen, and based on this investigation, it was possible to verify the possibility, need and legitimacy of teaching work in spaces school and non-school.
