Trata-se de uma an&#225;lise dos conceitos fundamentais que circunscrevem a fun&#231;&#227;o social da educa&#231;&#227;o massiva no capitalismo, hegemonizada sob a forma escolar: for&#231;a de trabalho e sujeito do direito. Os nexos sociais mercantis, sob a &#233;gide do movimento cego e autom&#225;tico da acumula&#231;&#227;o de capital, pressup&#245;em n&#227;o apenas a generaliza&#231;&#227;o do trabalhador "livre" dos meios de produ&#231;&#227;o, mas, tamb&#233;m, a universaliza&#231;&#227;o da forma direito, que dissimula a subordina&#231;&#227;o econ&#244;mica sob a m&#225;scara da igualdade entre propriet&#225;rios privados. Na primeira parte do texto faz-se uma breve retomada de uma interpreta&#231;&#227;o da cr&#237;tica do trabalho apresentada por Karl Marx em O Capital, para assim poder passar &#224; cr&#237;tica marxista do direito, na segunda parte, com base em estudos de Evg&#232;ne Pachukanis, Walter Benjamin e Bernard Edelman. Em rela&#231;&#227;o &#224; esta apresenta&#231;&#227;o, extrai-se, &#224; guisa de conclus&#227;o e de modo preliminar, algumas consequ&#234;ncias te&#243;ricas para a apreens&#227;o do modo especificamente capitalista de educar.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[This article consists of an introductory exposition to the Marxist critique of law that, as we aim to demonstrate, provides relevant conceptual contributions to critical reflection on the specifically capitalistic social relations of education. It is an analysis of the fundamental concepts that circumscribe the social function of massive education in capitalism, under hegemony of the school form: workforce and subject of law. The mercantile social nexus, under the aegis of the blind and automatic movement of capital accumulation foresees not only the generalization of the worker "free" from the means of production, but also the universalization of the law-form, which conceals the economic subordination under the mask of equality between private owners. In the first section we briefly resumed a critical interpretation of the work presented by Karl Marx in Capital, in order to move on to the Marxist critique of law and in the second part, based on Evg&#232;ne Pachukanis, Walter Benjamin and Bernard Edelman&#180;s studies. Based on this presentation, we extract, by way of conclusion and in a preliminary way, some theoretical consequences for the apprehension of the specifically capitalist way of education.]]></p></abstract>
<abstract abstract-type="short" xml:lang="es"><p><![CDATA[Este art&#237;culo consiste en una exposici&#243;n introductoria a la cr&#237;tica marxista del derecho que, como pretendemos demostrar, oferece aportes conceptuales pertinentes a la reflexi&#243;n cr&#237;tica sobre las relaciones sociales de la educaci&#243;n espec&#237;ficamente capitalista. Es un an&#225;lisis de los conceptos fundamentales que circunscriben la funci&#243;n social de la educaci&#243;n de masas en el capitalismo, bajo la hegemonia de la forma de la escuela: fuerza de trabajo y sujeto de derecho. Las relaciones sociales mercantiles, bajo la &#233;gida del movimiento ciego y autom&#225;tico de la acumulaci&#243;n de capital presupone no s&#243;lo la generalizaci&#243;n del trabajador "libre" de los medios de producci&#243;n, sino tambi&#233;n la universalizaci&#243;n de la forma derecho, que esconde la subordinaci&#243;n econ&#243;mica bajo la m&#225;scara de la igualdad entre propietarios. En la primera parte del texto reanudamos brevemente una interpretaci&#243;n cr&#237;tica del trabajo presentada en "El Capital" de Karl Marx, para posteriormente en un segundo momento, presentar la cr&#237;tica marxista del derecho, con base en estudios de Evgene Pachukanis, Walter Benjamin y Bernard Edelman. Sobre la base de esta presentaci&#243;n, se extrae, a modo de conclusi&#243;n y de forma preliminar, algunas consecuencias te&#243;ricas para la aprehensi&#243;n del modo especificamente capitalista de educar.]]></p></abstract>
