O envolvimento da atuação do Judiciário em políticas públicas, todavia, ainda encontra resistência, principalmente quando a intervenção discute o financiamento desse direito. O objetivo deste artigo, portanto, é mapear e analisar as decisões envolvendo o financiamento da educação básica proferidas pelas Cortes de Justiça do Brasil. Para tanto, realizou-se um levantamento da jurisprudência nos cinco Tribunais Regionais Federais (TRFs) e em 10 Tribunais de Justiça Estaduais (TJEs) (Acre, Amazonas, Bahia, Ceará, Mato Grosso, Pará, Paraná, Pernambuco, São Paulo e Sergipe), sendo analisado um conjunto de 1.021 ementas de decisões dos TRFs e 393 dos TJEs. A análise dos dados demonstra que, nos TRFs, as temáticas discutidas dizem respeito às questões que envolvem relações interfederativas, principalmente sobre os recursos do Fundo de Manutenção e Desenvolvimento do Ensino Fundamental e de Valorização do Magistério (Fundef) e do Fundo de Manutenção e Desenvolvimento da Educação Básica e de Valorização dos Profissionais da Educação (Fundeb), enquanto, nos TJEs, envolvem a operacionalização dos mecanismos de financiamento e seus reflexos entre a administração pública e os profissionais da educação.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[Abstract Over the last few decades, the Judiciary has been employed to discuss the guarantee and expansion of the right to education. Nevertheless, the involvement of the Judiciary in public policies still faces resistance, especially when the intervention discusses the financing of this right. The aim of this article is, thus, to map and analyze the decisions handed down by the Brazilian courts involving the financing of basic education. To this end, a survey of case law was carried out in the five Federal Regional Courts (TRF) and ten State Courts of Justice (TJE) (Acre, Amazonas, Bahia, Ceará, Mato Grosso, Pará, Paraná, Pernambuco, São Paulo and Sergipe), analyzing a set of 1,021 sentences of decisions from the TRFs and 393 from the TJE. The data analysis reveals that, in the TRFs, the topics discussed are related to issues which involve inter-federative relations, mainlyFundo de Manutenção e Desenvolvimento do Ensino Fundamental e de Valorização do Magistério(Fundef) and Fundo de Manutenção e Desenvolvimento da Educação Básica e de Valorização dos Profissionais da Educação (Fundeb) resources.Meanwhile, in the TJE they involve the operationalization of funding mechanisms and their impact on public administration and education professionals.]]></p></abstract>
<abstract abstract-type="short" xml:lang="es"><p><![CDATA[Resumen En las últimas décadas, el Poder Judicial ha sido utilizado para discutir la garantía y la ampliación del derecho a la educación. El involucramiento de la actuación del Poder Judicial en políticas públicas, sin embargo, aún encuentra resistencias, especialmente cuando la intervención discute la financiación de este derecho. El objetivo de este artículo, por lo tanto, es mapear y analizar las decisiones relativas a la financiación de la educación básica dictadas por los Tribunales de Justicia de Brasil. Para ello, se realizó una recopilación de la jurisprudencia en los cinco Tribunales Regionales Federales (TRFs) y en 10 Tribunales de Justicia de los Estados (TJEs) (Acre, Amazonas, Bahía, Ceará, Mato Grosso, Pará, Paraná, Pernambuco, São Paulo y Sergipe) y se analizó un conjunto de 1.021 resúmenes de decisiones de los TRFs y 393 de los TJEs.
