Para o desenvolvimento do texto, utilizou-se pesquisa bibliogr&#225;fica, documental e dados referentes &#224; pesquisa realizada pela Uni&#227;o Nacional dos Conselhos Municipais de Educa&#231;&#227;o (UNCME), em 2015, sobre a institucionaliza&#231;&#227;o e o funcionamento dos CME no Maranh&#227;o. Constatou-se que as leis dos CME dos munic&#237;pios pesquisados n&#227;o trazem, explicitamente, o princ&#237;pio da gest&#227;o democr&#225;tica. A aus&#234;ncia de tal princ&#237;pio, como parte da gest&#227;o do Sistema Municipal de Educa&#231;&#227;o, pode prejudicar o fortalecimento dos espa&#231;os de participa&#231;&#227;o, de constru&#231;&#227;o da autonomia, de descentraliza&#231;&#227;o do poder local e de exerc&#237;cio da cidadania no &#226;mbito do munic&#237;pio.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[Abstract: This paper analyzes how the principle of democratic management, established in the Federal Constitution of 1988 and in the National Education Guidelines and Framework Law no. 9.394/1996, is included in the Laws of creation of the Municipal Councils of Education -(called CME) from Barreirinhas, Cod&#243; and Icatu, municipalities of the State of Maranh&#227;o, Brazil. For the development of this paper, we used bibliographical, documentary research and data related to the research done by the National Union of Municipal Councils of Education (called UNCME), in 2015, on the institutionalization and functioning of CME in Maranh&#227;o. We found that the laws of the CME of the municipalities surveyed do not explicitly bring the principle of democratic management into practice. The absence of such a principle, as part of the management of the Municipal Education System, can hamper the strengthening of spaces of participation, construction of autonomy, decentralization of local power and exercise of citizenship within the municipality.]]></p></abstract>
<abstract abstract-type="short" xml:lang="es"><p><![CDATA[Resumen: En este art&#237;culo se analiza c&#243;mo el principio de la gesti&#243;n democr&#225;tica, dispuesto en la Constituci&#243;n Federal de 1988 y en la Ley de Directrices y Bases de la Educaci&#243;n -Ley n&#186; 9.394/1996, consta en las leyes de creaci&#243;n de los Consejos Municipales de Educaci&#243;n (CME) de Barreirinhas, Cod&#243; e Icatu, municipios en el estado de Maranh&#227;o. Para desarrollo del texto, se utiliz&#243; la investigaci&#243;n bibliogr&#225;fica, documental y datos referentes a la investigaci&#243;n efectuada por la Uni&#243;n Nacional de los Consejos Municipales de Educaci&#243;n (UNCME), en 2015, sobre la institucionalizaci&#243;n y el funcionamiento de los CME en Maranh&#227;o. Se constat&#243; que las leyes de los CME de los municipios investigados no traen, expl&#237;citamente, el principio de la gesti&#243;n democr&#225;tica. La ausencia de tal principio, como parte de la gesti&#243;n del sistema municipal de educaci&#243;n, puede perjudicar el fortalecimiento de los espacios de participaci&#243;n, de construcci&#243;n de la autonom&#237;a, de descentralizaci&#243;n del poder local y de ejercicio de la ciudadan&#237;a en el &#225;mbito del municipio.]]></p></abstract>
