<self-uri xlink:href="http://educa.fcc.org.br/scielo.php?script=sci_arttext&amp;pid=S1981-81062018000300662&amp;lng=en&amp;nrm=iso"></self-uri><self-uri xlink:href="http://educa.fcc.org.br/scielo.php?script=sci_abstract&amp;pid=S1981-81062018000300662&amp;lng=en&amp;nrm=iso"></self-uri><self-uri xlink:href="http://educa.fcc.org.br/scielo.php?script=sci_pdf&amp;pid=S1981-81062018000300662&amp;lng=en&amp;nrm=iso"></self-uri><abstract abstract-type="short" xml:lang="pt"><p><![CDATA[Resumo Este artigo propõe examinar como objetivos e metas para a educação presentes na Agenda 2030, aprovada pelas Nações Unidas em 2015, e a Emenda Constitucional 95 que institui o novo regime fiscal no Brasil, contribuem para a erosão do direito à educação no caso brasileiro. Há, no Brasil, um ordenamento jurídico, resultado de lutas históricas da sociedade civil e de entidades academicas e sindicais, que assegura o direito à educação, culminando na atualidade com a Emenda Constitucional nº 59/2009 e a Lei 12.796 de 4 de abril de 2013, que torna a educação básica obrigatória e gratuita dos 4 (quatro) aos 17 (dezessete) anos de idade. Este é um estudo qualitativo, de cunho bibliográfico e de análise documental, com dados coletados em 2015 e 2016. Os resultados apontam que apesar de a Agenda 2030 acenar para o direito à educação ao longo da vida, deixa lacunas quanto à execução em regime de parcerias público-privadas e à privatização da educação. Nesse último aspecto, a Emenda Constitucional 95 está em acordo com a referida Agenda; mas fica o alerta de que a luta pelo direito à educação continua em pleno vigor.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[Abstract The purpose of this article is to examine how goals and objectives for education present in 2030 Agenda, adopted by the UN in 2015, and the Constitutional Amendment nº 95 that established the new tax regime in Brazil, contribute to the erosion of rights to education in the case of Brazil. There is, in Brazil, a legal system resulting from historic struggles of civil society, academic entities and unions, which ensures the right to education, culminating today with the Constitutional Amendment nº 59/2009 and the law nº 12.796, April 4th of 2013, which makes basic education mandatory and free since the age of 4 (four) to 17 (seventeen) years old. This is a qualitative, bibliographic and documental analysis study, with gather data in 2015 and 2016. The results indicate that although Agenda 2030 wave to the right to education throughout the lifetime, leaves gaps for the enforcement under public-private partnerships and privatization of education. In this last aspect, the Constitutional Amendment nº 95 is in accordance with Agenda 2030; but remains here, the alert that the fight for the right to education continues in full force.]]></p></abstract>
<abstract abstract-type="short" xml:lang="es"><p><![CDATA[Resumen El objetivo de este artículo es examinar cómo los objetivos y metas para la educación presente en la Agenda 2030, aprobada por las Naciones Unidas en 2015, y la Enmienda Constitucional 95 que establece el nuevo régimen fiscal en Brasil contribuyen a la erosión del derecho a la educación en el caso brasileño. Hay, en Brasil, un ordenamiento jurídico, resultado de luchas históricas de la sociedad civil y de entidades académicas y sindicales, que asegura el derecho a la educación, culminando en la actualidad con la Enmienda Constitucional nº 59/2009 y la Ley 12.796 del 4 de abril de 2013, que hace que la educación básica obligatoria y gratuita de los 4 (cuatro) a los 17 (diecisiete) años de edad. Este es un estudio cualitativo, de cuño bibliográfico y de análisis documental, con datos recolectados en 2015 y 2016. Los resultados apuntan que, a pesar de que la Agenda 2030 se centra en el derecho a la educación a lo largo de la vida, deja huecos en cuanto a la ejecución en régimen de asociaciones público-privadas ya la privatización de la educación. En este último aspecto, la Enmienda Constitucional 95 está en acuerdo con la referida Agenda; pero queda el alerta de que la lucha por el derecho a la educación continúa en pleno vigor.]]></p></abstract>
