<self-uri xlink:href="http://educa.fcc.org.br/scielo.php?script=sci_arttext&amp;pid=S1981-81062021000100132&amp;lng=en&amp;nrm=iso"></self-uri><self-uri xlink:href="http://educa.fcc.org.br/scielo.php?script=sci_abstract&amp;pid=S1981-81062021000100132&amp;lng=en&amp;nrm=iso"></self-uri><self-uri xlink:href="http://educa.fcc.org.br/scielo.php?script=sci_pdf&amp;pid=S1981-81062021000100132&amp;lng=en&amp;nrm=iso"></self-uri><abstract abstract-type="short" xml:lang="pt"><p><![CDATA[Resumo O artigo tem como objetivo discutir a progressiva adoção do direito à educação pelo Estado brasileiro nas Constituições Federais de 1824 a 1988 e na Lei de Diretrizes e Bases da Educação Nacional (Lei nº 9.394) de 1996, em contraposição com as políticas sociais e educacionais contemporâneas que limitam o usufruto desse direito fundamental, como a Emenda Constitucional nº 95/2016, a Base Nacional Comum Curricular e a Reforma do Ensino Médio (Lei nº 13.415/2017). Nessa perspectiva, para o desenvolvimento do objetivo proposto, apresenta-se uma breve digressão histórica acerca da constituição legal do direito à educação no Brasil, e, posteriormente, um balanço inicial sobre o impacto das políticas sociais e educacionais supracitadas, em um contexto de aprofundamento dos ajustes neoliberais na segunda década do século XXI. Como resultado, observa-se que, ao contrário de contextos históricos anteriores, nos quais o direito à educação era abertamente negado por governos elitistas e autoritários, com as políticas neoliberais esse direito é limitado &#8220;por dentro&#8221; do Estado democrático, em um contexto de aprofundamento da crise do capitalismo em escala global.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[Abstract The article aims to discuss the progressive adoption of the right to education by the Brazilian State in the Federal Constitutions from 1824 to 1988 and in the Law of Directives and Bases of National Education (LDB/Law nº 9.394) of 1996, in opposition to social and political policies contemporary educational activities that limit the enjoyment of this fundamental right, such as Constitutional Amendment nº 95/2016, the Common National Curriculum Base (BNCC) and the High School Reform (Law nº 13.415/2017). In this perspective, for the development of the proposed objective, a brief historical digression about the legal constitution of the right to education in Brazil is presented, and, later, an initial assessment of the impact of recent social and educational policies, in a context of deepening neoliberal adjustments in the second decade of the 21st century. As a result, it is observed that, unlike previous historical contexts, in which the right to education was openly denied by elitist and authoritarian governments, with neoliberal policies this right is limited &#8220;within&#8221; the democratic state, in a context of deepening of the crisis of capitalism on a global scale.]]></p></abstract>
<abstract abstract-type="short" xml:lang="es"><p><![CDATA[Resumen El artículo tiene como objetivo discutir la adopción progresiva del derecho a la educación por parte del Estado brasileño en las Constituciones Federales de 1824 a 1988 y en la Ley de Directrices y Bases de la Educación Nacional (Ley N ° 9.394) de 1996, en contraste con las leyes sociales contemporáneas. y políticas educativas que limitan el goce de este derecho fundamental, como la Enmienda Constitucional No. 95/2016, la Base Curricular Nacional Común y la Reforma de la Educación Secundaria (Ley No. 13.415 / 2017). Desde esta perspectiva, para el desarrollo del objetivo propuesto, se presenta una breve digresión histórica sobre la constitución jurídica del derecho a la educación en Brasil y, posteriormente, una evaluación inicial del impacto de las políticas sociales y educativas antes mencionadas, en un contexto de profundización de los ajustes neoliberales en la segunda década del siglo XXI. Como resultado, se observa que, a diferencia de contextos históricos anteriores, en los que el derecho a la educación fue negado abiertamente por gobiernos elitistas y autoritarios, con las políticas neoliberales este derecho se limita "dentro" del Estado democrático, en un contexto de profundización del crisis del capitalismo a escala global.]]></p></abstract>
