Para isso, é realizada uma pesquisa qualitativa, de caráter documental, da Resolução nº 1, de 13 de novembro de 2020, emitida pela Câmara de Educação Básica do Conselho Nacional de Educação. Trata-se do primeiro documento federal que aborda especificamente a educação básica para a população proveniente de fluxos migratórios internacionais. A análise do documento tem por objetivo compreender como a resolução apresenta o direito à educação da criança migrante e refugiada, observando o contexto da escola pública. O resultado da análise aponta que o documento trata esse direito em dois eixos: matrícula e ensino, de forma que um é indissociável do outro. Entretanto, apesar de considerar o direito à educação para além da matrícula, a resolução imputa uma responsabilização à escola local, que muitas vezes recebe as crianças sem que os profissionais da instituição tenham apoio e orientação. O documento também não menciona outros atores necessários na concretização desse direito, como estados e municípios, além das universidades, que atuam na formação de professores.]]></p></abstract>
<abstract abstract-type="short" xml:lang="en"><p><![CDATA[Abstract In this article, the right to education of migrant and refugee children in Brazilian public schools is discussed. For this, qualitative research of a documentary nature is carried out, of Resolution nº 1 of November 13, 2020, issued by the Basic Education Chamber of the National Council of Education. It is the first federal document that specifically addresses basic education for the population coming from international migratory flows. The analysis of the document aims to understand how the resolution presents the right to education of migrant and refugee children, observing the context of public schools. The result of the analysis shows that the document deals with this right in two axes: enrollment and education, so that one is inseparable from the other. However, despite considering the right to education beyond enrollment, the resolution places responsibility on the local school, which often receives children without the institution's professionals having support and guidance. The document also does not include other actors necessary for the realization of this right, such as states and cities, in addition to universities, which work in teacher training.]]></p></abstract>
<abstract abstract-type="short" xml:lang="es"><p><![CDATA[Resumen Este artículo discute u orienta la educación de los niños migrantes y refugiados en las escuelas públicas brasileñas. Para ello, se realizó una investigación cualitativa, de carácter documental, de la Resolución nº 1 del 13 de noviembre de 2020, emitida por la Sala de Educación Básica del Consejo Nacional de Educación. Es el primer documento federal que aborda específicamente la educación básica para la población proveniente de flujos migratorios internacionales. El objetivo del análisis documental es comprender cómo la resolución presenta u orienta la educación de los niños migrantes y refugiados, observando el contexto de la escuela pública. El resultado del análisis indica que el documento trata de esta ley en dos casos: matrícula y educación, por lo que uno es inseparable del otro. Sin embargo, a pesar de considerar u orientar la educación más allá de la matrícula, la resolución asigna una responsabilidad a la escuela local, que muchas veces recibe a los niños sin que los profesionales de la institución cuenten con el apoyo y la orientación. El documento tampoco incluye otros actores necesarios para la implementación de esta ley, como los estados y municipios, además de las universidades, que trabajan en la formación docente.]]></p></abstract>
