The objective of this article is to analyze the process of implementing educational legislation throughout Brazil empire (1822-1889) and its implications for the lives of black captives. It seeks to verify the advances and setbacks in educational legislation regarding blacks and how these laws were put into practice in practice, observing the material and political conditions of the time. The struggle for abolition intensified by the end of the 1880 years as the slave labor got more antiquated to the Brazilian bourgeoisie interests and the international pressure. The results of the study indicate that educational laws, in this sense, indicated the need to civilize Brazil so that the poor and blacks could adapt to the new capitalist demands and, thus, allow Brazil to achieve higher levels of economic and social progress.
