This article deals with the right sof indigenous Brazilians. Begins with the approach of the rights recognized in the Constitution of 1988 which supplanted the colonial paradigm of denial, to establish the period of recognition of rights differentiated identity, subjectivity, community, society, territory and self-determination. Discusses the new indigenous citizen ship de colonized, active e and creative due to the constitutional recognition of multiple ways of being, doing and living that shape collective indigenous cultural rights.
