Abstract

This article analyzes the course of Law nº 3.018, of April 17, 2013, which institutes Democratic Management in the State Public Education Network of Rondônia, approved in Confúcio Aires Moura’s (2011-2014) government, of the Party of the Brazilian Democratic Movement (PMDB). The Law underwent different modifications that culminated, in 2019, in its request for revocation in the Legislative Assembly of Rondônia (Alero); act contested by the Union of Education Workers of Rondônia (Sintero), which filed a Collective Writ of Mandamus in the State Court of Justice (TJRO), being rejected in 2020. The time frame for analysis considers the year of approval of the Law and the decision of the state judiciary on the contestation of the union entity. The methodology encompasses document analysis and theoretical framework based on historical-dialectical materialism. The results show contradictions in the series of modifications of Law nº 3.018/2013, in addition to the disregard of the vector elections for school directors in state education units, prioritizing the designation by the executive branch, without consulting the community, according to Ordinance published by the government of Marcos José Rocha dos Santos (2019-2022), from the Social Liberal Party (PSL), at the time, supported by the understanding of the TJRO, which decided for the unconstitutionality of the election, claiming that it was a commissioned position.
