The objective of this study was to analyze the transition of daycare centers from assistance sector to the educational sector becoming Municipal Schools of Early Childhood Education (EMEIs). The present study was based on the discourse of twenty monitors, eighty teachers and three managers from a municipality in the interior of the state of Rio Grande do Sul (RS). Data and speeches are the result of questionnaires, semi-structured interviews and a dialogue group. Dialectical analysis was applied in the categories that support the discourses of the workers in order to understand the relevance of their speeches and writings in elucidating of the transition of this institution, taking into account its historicity and the totality in which they are inserted. It was verified that the EMEI and the educational policies intended for this educational level are not guaranteeing the structure, the organization and the financial resources that can subsidize an education designed for and from the child. What has been recurrent is just the right of families to have a place to leave their children while they work, without necessarily ensuring the conditions for the production of pedagogical work aimed at childhood. This process ends up reinforcing the care character of this institution to the detriment of the educational one.
