In this paper the author analyses one of the main topic of discussion in indigenous education these days which is the debate about whether the central government should be responsible for this policy and how to organize the Brazilian public administration to assume that responsibility respecting the specificity of indigenous peoples in the country. The text was produced from data collected from interviews and documentary research by the author who did research for the National Council of Education. The text shows how this debate over who should take responsibility for indigenous education has been around from 1991 until today with the publication of the Decree 6.861/09 and proposal of the Statute of Indigenous Peoples of the National Commission on Indigenous Politics.
