The process of institutionalisation of home education in Brazil has raised polemic and hermeneutic disagreements about its constitutionality. From bibliographical and documental research, we focus on antinomies between this type of education, the public sector and the right to education. Document analysis was based on the focus of the theme in Brazilian constitution, with emphasis on the regulation of the Federal Constitution of 1988, Law nº 9.394/1996 and the Statute of Children and Adolescents. Among the results obtained, the segregating and elitist character of Home Education stands out; the dispute over public resources for a modality that is adverse to the republican and universal character of public education; the commercial nature of the production of teaching material and private consultancy.
