This article systematizes the result of a survey carried out from 2019 to 2021. It discusses the existence of state public policies for the inclusion and qualitative insertion of the Haitian population in Basic Education schools in the State of Santa Catarina. For this, it follows an investigative path through three instances, the State Department of Education of Santa Catarina, the State Council of Education and the Legislative Assembly, through which it is possible to identify the dynamics and permeabilities of the State to the new demands, and to inventory the documents from these instances aimed at immigrant populations. From the set of sources, the Law establishing the state policy for the immigrant population stands out. The Documents are analyzed in the light of educational policies and Content Analysis. It is concluded that there is still an invisibility on the part of public policies, especially those specific to the educational field. However, advances are recognized with the establishment of a state policy for this population, which will enable the emergence of public policies in education.
