Abstract

This article approaches the question of democratization of public teaching, focusing on the principles of participation and autonomy of the Counties in the constitution of its County Systems of Education – SME. For its accomplishment, bibliographical and documental research was used, the first through theoretical contributions of authors that study the theme, and the second through analysis of the legislation and the Laws of creation of the SME in the State of Maranhão. The article brings theoretical and legal aspects that deal with the autonomy of the Counties’ functioning as federated entities, and also data from the laws of the SME of the counties of Maranhão that constituted their educative systems. It was concluded that the democratization of the management is a legal prerogative; however, some laws of the SME are still incipient when it comes to the principles that substantiate them.
